Terms and conditions

1. Definitions

In these terms and conditions, the following words shall have the following meaning:
"APL" means l’Association des Parents d’Eleves du Lycee, which represents the parents’ interests vis-à-vis the teachers, the Lycee’s administration and other official bodies;
“Lycee” means the Lycee Francais Charles de Gaulle in London with its four sites of South Kensington, Marie d'Orliac, Wix and Andre Malraux;
“APL Welfare Fund” means the charity registered under number 1082875;
“Friends of the Lycee” means the charity registered under number 1000639;
“Website” means the APL website;
“Material” means all of the information, data, text, graphics, links or computer code published on, contained or available on the Website including the APL name and logo;
"User" means any individual, company or otherwise accessing the Website or making a payment or a donation through the Website;

2. Applicable terms and conditions

The Website is owned and controlled by APL and any use made of this site (including registrations, payments and donations made through the Website), is subject to these terms and conditions. APL may, at its sole discretion, modify these terms and conditions at any time and such change shall be effective immediately.

3. Use of the Website

Any information accessed through the Website may be used for personal use only and not for reproduction on any other website or for commercial gain.
Any link created to the Website must be notified to, and approved by, APL before it is created.

4. Copyright and trade marks

Copyright in the Material is owned by APL or its content suppliers. Unauthorised use of the Material including reproduction, storage, modification, distribution or republication without the prior written consent of APL or, where applicable, its copyright owner, is prohibited.

5. Disclaimer

The information provided on this Website is intended to provide general information only and, as such, should not be considered as a substitute for advice covering any specific situation. Users should seek appropriate advice before taking or refraining from taking any action in reliance on any information contained in the Website. Whilst APL has taken every precaution in compiling the Website, it cannot warrant that the information accessible via the Website is accurate, complete or correct and neither APL nor any contributors to the Website can be held responsible for any action (or the lack thereof) taken by any person or organisation, as a result, direct or otherwise, of information contained in or accessed through the Website.

So far as permissible by law, APL excludes all liability to any person relating to the use of any Material or the provision of any goods or services through the Website [except in the case of personal injury or death caused by the negligence of APL. APL hereby disclaims all warranties and conditions regarding the Material and any goods or services supplied through the Website, whether express, implied or statutory (including all implied warranties and conditions of merchantability and fitness for a particular purpose).

6. Warranty and indemnity

The User warrants to APL that it will not use the Website, the Material or any part thereof for any purpose that is in contravention of any applicable law or regulation or in a manner that may infringe the copyright, trademarks, service marks or other intellectual property rights of third parties or violate the privacy, publicity or other personal rights of others or in any defamatory, obscene, threatening, abusive or hateful manner. The User shall indemnify APL and its agents, and hold them harmless against all claims, liability, losses, damages and expenses (including, without limitation, legal fees) arising out of any claims made against APL and its agents, as a result of the use by the User of the Website, the Material or any part thereof for whatever purpose.

7. Third party websites

The Website may contain links to websites operated by parties other than APL. Such links, if any, are provided for the User's convenience only. APL does not control such websites, and is not responsible for their content. APL's inclusion of links to such websites does not imply any endorsement of the material on such websites or any association with their operators.

8. Privacy and Data Protection

Our Privacy Statement can be read in full at the office and by using the Website and/or making a payment or a donation through the Website, Users automatically agree to the processing and transfer where applicable of their data, including any sensitive data.

9. Viruses

Whilst APL makes all reasonable attempts to exclude viruses from the Website, it cannot ensure such exclusion and no liability is accepted for any damage caused as a result of viruses downloaded through the Website.

10. On-line Transactions

APL yearly registration fee, which currently amounts to £15, may be paid on-line through the Website. Once paid, that fee is non-refundable.
Any subscription by a User to the CGEA insurance through the Website can be cancelled by the User for any reason within seven days, provided a written notice to this effect is sent to APL at the following address 35 cromwell road, London SW7 2DG. In such circumstances, the relevant subscription will be refunded by APL in full within 30 days.
Any donation made by a User to APL, APL Welfare Fund and/or Friends of the Lycee on-line via the Website is non-refundable.
APL reserves the right to vary its registration fee and the prices of any services listed without notice. All registrations and orders for services are subject to availability and APL reserves the right to refuse to accept any registration and to refuse to supply any services to any User.

11. Encryption

Although the Website uses encryption security software in areas where on-line payment details are accepted, the security of information and payments transmitted via the internet cannot be guaranteed. Any loss incurred or sustained by any User who transmits information or payment by means of e-mail or other internet links shall be borne solely and exclusively by such User and in no event shall any such loss in whole or part be borne by APL or its agents.

12. General

If any provisions of these terms and conditions are held to be invalid or unenforceable, the validity or enforceability of the remaining provisions shall not be affected. These terms and conditions constitute the entire agreement between APL and the User and supersede all other communications and proposals, whether electronic or written, between the User and APL. Any failure of APL to exercise or enforce any of its rights under these terms and conditions shall not be deemed to be a waiver of any such rights or operate so as to bar the subsequent exercise or enforcement of any such rights.

13. Jurisdiction

The terms and conditions and the use by the User of the Website shall be governed by the laws of England and Wales and the parties hereto submit to the exclusive jurisdiction of the English courts in all disputes arising out of or relating to the Website and/or any transactions made on the Website, or these terms and conditions.

How do we collect information?

We may obtain personal information about you when you enquire about our activities, register with us, make a payment or a donation to us or otherwise provide us with personal information. We may also receive information about you from third parties.

What information do we collect?

The type of information collected may include names, date of birth, e-mail address, postal address, telephone number, fax number and credit/debit card details.

How do we use this information and can we disclose it to outside parties?

We may use your personal information to provide you with the services or information you have requested, for administration purposes and to further our charitable aims, including for fundraising activities.
We may need to share your information with our service providers, associated organisations and agents for these purposes, and, if you have consented, to other organisations who may share our objectives. We only use your personal information for direct marketing purposes if we are allowed to do this by law or if we have your consent. You can change your mind at any time by notifying the APL Committee in writing.

APL uses cookies to ensure that you can interact with our website successfully, to identify you when you visit our website and to keep track of your browsing patterns. The use of cookies does not give us access to the rest of your computer.

We use a secure server when you make a payment or a donation via our website. We also take appropriate measures to ensure that the information disclosed to us is kept secure, accurate and up to date to the extent that APL has been kept informed us of any relevant changes and kept only for so long as is necessary for the purposes for which it is used.

You also consent to our transferring your information to countries or jurisdictions which do not provide the same level of data protection as the UK, if necessary for the above purposes.
